1 Publisher and acceptance
The COBA app and the coba-app.com website are published by Steve Cohen, sole proprietor (micro-entreprise), 10 rue du Gypse, 11100 Narbonne, France, hereinafter “COBA”. These Terms of Use form an agreement between you and COBA. By creating an account, accessing the service or using the app, you accept them. Full legal notices are available on the dedicated page of this website.
2 Service description
COBA is a mobile community app for nomadic travelers. It lets you discover other travelers around you on a real-time map, exchange messages, organize spontaneous meetups (Apero), ask for help (Help), join events and use practical tools designed for life on the road.
3 Minimum age
COBA is restricted to people aged 15 or older. By creating an account, you confirm that you are at least 15. If you are between 15 and 18, you confirm that you use COBA with the consent of your legal guardian.
4 Your account
You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for keeping your credentials confidential and for all activity performed from your account. An account is personal: it may not be transferred or shared.
5 Subscriptions and purchases
COBA offers an optional subscription (COBA+), either auto-renewable (monthly or yearly) or lifetime (one-time payment). The price, duration and benefits are shown before purchase confirmation. Subscriptions are billed through your App Store (iOS) or Google Play (Android) account and renew automatically unless canceled at least 24 hours before the end of the current period in the relevant store settings; refunds are handled under Apple's and Google's terms. Some optional contributions (for example to sticker shipping costs) are paid by card via Stripe. By purchasing digital content delivered immediately, you consent to its immediate performance and waive your right of withdrawal to the extent permitted by law.
6 User content
You retain your rights to the texts, photos, videos, voice messages, information and other content you publish or send in COBA. You grant COBA a non-exclusive, worldwide, free license limited to what is necessary to host, reproduce, display and distribute that content in the app and provide the service.
7 Conduct rules
You agree not to publish, send or promote illegal, hateful, violent, discriminatory, harassing, misleading or pornographic content, content that infringes third-party rights, or spam — including in private conversations — and not to solicit other users for unwanted sexual or commercial purposes. You also agree to use COBA fairly and respectfully.
8 Reporting and moderation
Any message, profile or conversation can be reported directly from the app (spam, harassment, shocking content, other). Every report is reviewed by a human moderator — no moderation decision is fully automated. An automated tool may also analyze conversations to flag those likely to break these rules and prioritize them for moderation; every decision remains made by a human. To investigate a report, the moderation team may review the conversation concerned and keep a copy of it as evidence, even if the content is later edited or deleted; this processing is detailed in the Privacy Policy. After review, the report is either confirmed or dismissed: depending on the severity and repetition of the facts, content may be removed and the account warned, suspended or deleted. If your content or account is subject to a measure you believe is unjustified, you can contest it by writing to support; your request will be reviewed by a human.
9 Termination
You may stop using COBA and request deletion of your account at any time from the app. COBA reserves the right to suspend or delete an account, remove content or limit access to the service in case of violation of these terms, abusive behavior or risk to the security of the service or users.
10 Limitation of liability
COBA provides the service with reasonable care, without guaranteeing uninterrupted availability, error-free operation or compatibility with every use. COBA is not liable for user-published content, interactions and meetups between users, or indirect damages, data loss, revenue loss or lost opportunities resulting from use of the service. Nothing in these terms excludes liability that cannot be limited by law.
11 Personal data
The processing of your personal data is described in our Privacy Policy, available at Privacy Policy.
12 Consumer mediation
In accordance with articles L.611-1 et seq. of the French Consumer Code, any consumer has the right to use a consumer mediation scheme free of charge to seek an amicable resolution of a dispute. For purchases made through the App Store, Apple acts as the seller and billing disputes are handled directly by Apple. For any other dispute, please contact our support first, which will strive to find an amicable solution; the contact details of the competent mediator will be provided in that context. You may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
13 Governing law
These terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution before any legal action.
